By using RentCafe.com (RentCafe ILS) or any property websites powered by RentCafe (RentCafe Portal) (collectively, “RentCafe”), you acknowledge you have read and understand the latest version of the RentCafe Privacy Policy (posted at https://resources.yardi.com/legal/rentcafe-privacy-policy/), which describes RentCafe’s privacy practices and will be updated from time to time. The property may have its own Privacy Policy that describes the property’s privacy practices.


Bigos Management — PRIVACY POLICY

This Privacy Policy (the "Privacy Policy") describes the privacy practices of Bigos Management ("Company," "we," "us," or "our") regarding information we collect from persons or entities ("you" or "your") who: (a) access our property's RENTCafé Resident Portal website or related mobile applications (collectively, the "Site"); or (b) participate in our SMS (text messaging) program described in Section 9 below (the "SMS Program"). 1. PURPOSE

The purpose of this Privacy Policy is to inform you about the types of information we gather about you — including information gathered when you visit the Site and information you provide by enrolling your Company-issued mobile number in our SMS Program — information we may receive from third parties or affiliates, how we may use that information, whether we disclose it to anyone, and the choices you have regarding our use of, and your ability to correct, that information. Company strives to help Site visitors and SMS Program participants protect their privacy.

2. CHILDREN'S PRIVACY

THE SITE AND THE SMS PROGRAM ARE NOT INTENDED FOR CHILDREN, AND COMPANY DOES NOT KNOWINGLY SOLICIT OR COLLECT PERSONAL INFORMATION FROM CHILDREN UNDER THE AGE OF 13. IF COMPANY LEARNS THAT A CHILD UNDER THE AGE OF 13 HAS SUBMITTED PERSONALLY IDENTIFIABLE INFORMATION, IT WILL TAKE REASONABLE MEASURES TO DELETE SUCH INFORMATION FROM ITS RECORDS AND TO NOT USE IT FOR ANY PURPOSE (EXCEPT WHERE NECESSARY TO PROTECT THE SAFETY OF THE CHILD OR OTHERS, AS REQUIRED BY LAW, OR AS OTHERWISE PERMITTED BY LAW).

PLEASE READ THIS ENTIRE PRIVACY POLICY CAREFULLY. BY USING THE SITE OR PARTICIPATING IN THE SMS PROGRAM, YOU EXPRESSLY CONSENT, WITHOUT QUALIFICATION, TO THE COLLECTION, USE AND DISCLOSURE OF INFORMATION, INCLUDING PERSONAL INFORMATION, AS DESCRIBED IN THIS PRIVACY POLICY. IF YOU DO NOT AGREE TO THE TERMS OF THIS PRIVACY POLICY, YOU ARE NOT AUTHORIZED TO USE THE SITE OR PARTICIPATE IN THE SMS PROGRAM.

Company may amend this Privacy Policy from time to time. Should it be modified in any way, the new version will be posted to this webpage. As we may make changes from time to time without separately notifying you, we suggest periodically reviewing this page. Continued use of the Site or continued participation in the SMS Program after the effective date of any modification constitutes your consent to the updated Privacy Policy.

4. TYPES OF INFORMATION COLLECTED

We collect two types of information: personally identifiable information and non-personally identifiable information. Personally Identifiable Information is information that identifies you or can be used to identify or contact you ("Personally Identifiable Information"). We also may collect information that by itself typically cannot be used to identify or contact you, such as demographic information (e.g., age, profession, or gender), browser types, domain names, internet service providers, referring/exit pages, date/time stamps, operating system, clickstream data, and other anonymous statistical data involving use of our Site ("Non-Personally Identifiable Information").

Personally Identifiable Information we collect may include, but is not limited to: your name, email addresses, postal addresses, postal codes, user Internet Protocol (IP) addresses, social security/insurance number, driver's license number, prior addresses, monthly rent paid at prior residences, employers, job titles, income, telephone numbers, credit card information, bank account information and routing numbers, date of birth, gender, age, marital status, user name and password, emergency contact information, information about your pets, information about your vehicles including license plate numbers, and other information either desirable or necessary to provide quality services to our customers and visitors.

SMS Program information. If you are an authorized employee enrolled in our SMS Program, we additionally collect: the mobile phone number associated with your Company-issued number, message content (limited to authentication/verification codes and related transactional text passed through by the third-party service you enrolled with), delivery status, opt-in/opt-out status, and timestamps associated with sending or receiving SMS messages.

You may choose not to provide your Personally Identifiable Information by not entering it on the Site or not enrolling in the SMS Program; however, certain services and features will be unavailable to you as a result.

5. USE OF COOKIES AND OTHER TECHNOLOGIES

Like many other website operators, Company may use cookies to customize content specific to your interests and track your use of the Site. "Cookies" are text files placed on your computer that may be used to store information about you. In addition to cookies, Company may use other now-known or later-developed technologies to observe visitor behavior on the Site; these technologies access individual user information, but that information is used only to compile aggregated usage statistics.

This Site uses Google Analytics (and in the future may use similar services), a web analytics service provided by Google, Inc. ("Google"), to better understand how the Site is used. Google Analytics places cookies on your computer that generate information about your use of the Site, including your computer's IP address, which is transmitted to and stored by Google for evaluating Site usage, compiling activity reports, and providing related services. Google may transfer this information to third parties where required by law or where such parties process it on Google's behalf. Google's use of cookies is covered by Google's privacy policy: https://www.google.com/policies/privacy/.

You can delete existing cookies, allow or block all cookies, and set site-specific preferences in your browser's settings. Note that blocking all cookies may limit the Site's full functionality. (This section applies to the Site; the SMS Program does not use cookies.)

6. HOW WE COLLECT AND USE INFORMATION

We may collect information through your use of the Site, forms you submit to us, personal correspondence (email or letters), applications you complete on the Site, property-visit scheduling, or your enrollment in the SMS Program. When you visit the Site, our servers may log your IP address, the URL of your request, and other HTTP header information. We may also ask you to voluntarily provide personal information — for example, to create an account, or to complete screening services. Declining to provide Personally Identifiable Information may make some features, products, or services unavailable to you.

Company may use information collected from you to provide requested services (including enabling use of the Resident Portal and the SMS Program), and to send you targeted messages, publications, news, and information about events, special offers, promotions, and benefits — except that information collected specifically through the SMS Program is used only as described in Section 9 and is never used for marketing (see Section 8).

7. MANAGING YOUR COMMUNICATIONS (EMAIL & SMS)

Email. You may receive emails from Company for a variety of reasons. If you have an account on the Site, you can manage preferences through your account settings, or by following the unsubscribe instructions in any email we send. Even after unsubscribing from certain correspondence, we may still need to email you important transactional or administrative information.

SMS. If you participate in the SMS Program, reply STOP to any message at any time to unsubscribe, or reply HELP for assistance. See Section 9 for full details.

8. SHARING OF INFORMATION COLLECTED

SMS / mobile data is never used for marketing. No mobile information, including phone numbers or SMS opt-in/consent data collected through the SMS Program, will be shared or sold to any third party or affiliate for marketing or promotional purposes. Mobile information may be shared only with subcontractors and messaging/carrier partners as necessary to provide the SMS service itself (e.g., message delivery, hosting, and support).

 

Except as set forth in this Privacy Policy or as you specifically agree, we will not disclose information we gather from you on our Site or through the SMS Program. We may share aggregated demographic and statistical information that is not personally identifiable with third parties, including corporate partners.

Company may also disclose an individual's personal information:

  • to a person who, in Company's reasonable judgment, is seeking the information as an agent of the individual;
  • where sharing is required in order to offer you products or services you have requested;
  • to a third party, where disclosure is required or permitted by law, a judicial proceeding, a criminal investigation, a court order, or legal process;
  • if, in Company's reasonable judgment, necessary to enforce our internal policies or Terms of Use, prevent illegal activity or suspected fraud, or protect our Site, customers, or others; and
  • to any entity that acquires all or a portion of our organization by merger, reorganization, operation of law, or sale of some or all of Company's assets.

Company may be required to use or disclose your information in connection with a legal action or other proceeding, including in response to a court order, subpoena, summons, or a law enforcement agency's request.

9. SMS / TEXT MESSAGING PROGRAM — DETAILS & TERMS

This section serves as both the privacy notice and the terms & conditions for our SMS Program and, together with Sections 4 and 8 above, is intended to satisfy carrier and messaging-provider disclosure requirements.

Program Description

Company issues mobile phone numbers to a limited number of authorized employees for business use. These numbers may be enrolled by the employee with third-party services (such as financial institutions, vendors, and software platforms) to receive one-time passcodes (OTPs) and account verification or authorization codes via SMS as part of two-factor authentication (2FA) for those third-party services. This is a low-volume, one-to-one conversational messaging program. Company does not send verification codes or other messages itself — codes originate from the third-party services the employee has enrolled with. The Program is not used for marketing, advertising, or bulk/automated messaging.

Consent / How You're Enrolled

Each employee is issued a Teams phone number as their official work contact number by Bigos Management IT. By registering that number with an external service for two-factor authentication, the employee affirmatively consents to receive SMS messages — including one-time verification and authorization codes — at that number.

Message Types & Frequency

Message frequency varies and is driven entirely by the recipient's own authentication activity (i.e., messages are sent only when a verification or authorization code is requested by that recipient). There is no recurring or scheduled messaging. Example message content passed through by third-party services includes:

  • "Your verification code is 482913. Do not share this code with anyone."
  • "123456 is your authorization code for [Vendor] account access. This code expires in 10 minutes."

Cost

Message and data rates may apply, depending on your mobile carrier plan. Bigos Management does not charge a fee to participate in the Program.

How to Opt Out

Reply STOP to any message at any time to be unsubscribed from the Program. You will receive one final confirmation message. To resubscribe, reply START.

Supported Carriers

Carriers are not liable for delayed or undelivered messages. Participation may not be available on all wireless carriers or in all areas.

No Sharing for Marketing

As stated in Section 8, mobile information and SMS opt-in/consent data are never shared or sold to third parties for marketing or promotional purposes.

10. HOW WE STORE YOUR INFORMATION

Company is committed to protecting the security of any personal information you provide to us. We maintain commercially reasonable safeguards to protect the security and privacy of that information. Company cannot guarantee the security of data submitted over the Internet, but once received it is protected by procedures and technology designed to block reasonably foreseeable intrusions by unauthorized third parties. We may store and process your personal information in the United States, Canada, or any other country in which we or our agents maintain facilities. By using the Site or the SMS Program, you consent to the transfer of your information among these facilities, including those outside your home country.

11. THIRD-PARTY WEBSITES

This Privacy Policy applies solely to information collected by Company. It does not apply to other websites accessible through the Site, including third-party websites, nor to the third-party services an employee independently enrolls with for SMS-based verification.

12. DATA RETENTION

To provide requested products and services, answer your questions, and meet our own accountability to external regulatory bodies, we retain your information for a period deemed reasonable under the circumstances, including SMS Program data (see Section 9). Information is removed, destroyed, or deleted when we no longer have a need to retain it, though retention may be extended where required or permitted by applicable law, or in connection with litigation, investigations, or proceedings.

13. ACCESSING, REVIEWING AND CHANGING YOUR PERSONAL INFORMATION

You can see, review, and change most of your personal information by logging into your account on the Site and editing your Account Profile, or by contacting us using the information in Section 14. If your personal information changes or is inaccurate, please update it promptly.

Some information may not be accessible, reviewable, or modifiable by you through your account. With some exceptions, you have the right to see what personal information we hold about you; we can help identify what records we may have and help you understand them. We may need to confirm your identity before providing access and may charge a nominal fee for such requests, or require the request in writing. If we cannot give you access, we will tell you within 30 days (or as soon as reasonably practicable) and provide a reason.

14. RIGHTS OF INDIVIDUALS

Site users who wish to correct, update, change, or erase information they submitted should return to the applicable web form or their account to edit their record. SMS Program participants may correct enrollment information through the third-party service they registered with, or by contacting us below. If you believe we have processed your personal data in violation of applicable law and we have failed to remedy the violation to your reasonable satisfaction, you may lodge a complaint with the data protection supervisory authority in your country.

16. CANADA

To the extent applicable, this policy is made under the Personal Information Protection and Electronic Documents Act. There are some rare exceptions to the commitments set out above.
